Warranty Statement
Each Product manufactured by Supplier is warranted to be free from defects in material and workmanship for a period of six months after date of purchase by Customer from Supplier. Supplier has no responsibility or liability under this warranty or otherwise for damages caused by improper application or abuse of the subject product by any Purchaser including, without limitation, applications beyond design specifications or for the purpose other than intended, as specified in the current Product literature. Vendor shall have no responsibility or liability under this warranty or otherwise for Purchaser’s failure to properly maintain or replace Products in accordance with original equipment manufacturer recommendations or industry standards, whichever is more stringent. The aggregate liability of Supplier to any party related to any claim or action arising out of or related to this Agreement shall not exceed the total amount received by Supplier for sales of Products under this Agreement in the twelve month period immediately preceding the event or circumstance giving rise to such liability.
